Case Study After graduation, you have decided to start a new Human Resources consulting company to help small businesses. You realized that although many large companies have Human Resources Departments that smaller companies often do not and could really benefit from the expertise you have gained in your education. Scenario 1 Karl comes to you to help him staff his Property Maintenance Company. They do small repairs, but most of the work performed is lawn care and painting. He is seeking quality employees quickly and hopes that you can help. He does not care about resumes,criminal background checks, or drug testing. He simply does not have time or money for these procedures. He requests 3 to 5 strong men to perform the duties of the job. He specified he does not want any white kids from the suburbs, as he does not believe they are hard workers. He also states that he does not care about work visas or whether they are citizens who are legally allowed to work in the U.S. In fact, he believes that most of his employees are illegals and he loves them because they work hard and do not expect much pay or any benefits. He states that he will pay them under the table, this way he does not have to deal with taxes or Worker Compensation issues. Karl states that he will pay you $500 for each worker that you find who lasts a week or more on the job. As a new consulting firm, you could really use the money. However, you are worried about the legal and ethical issues you see. Scenario 2 Dr. McNutty is a professor at the local college who has a large grant and needs to recruit people for his new study on fear and humiliation. Dr. McNutty is a brilliant scientist who is willing to cross the line to get accurate results, therefore many people have complained about his tactics in other studies. Because of this, the College’s HR department will not work with him anymore and he calls you. He is seeking 10 new participants; 2 extremely attractive female actors, 2 male stuntmen, and 6 unattractive and nerdy male test subjects. Everyone will be paid very well and all will be asked to sign a release that absolves himself, the University, and you from any legal liabilities resulting from the study. However, you know that these documents are not valid if the person is misled while signing them or if someone gets hurt. The study places each test subject (who are completely unaware of the study) in a situation where the female actor lures them in to thinking that they are attracted to the test subject, and they begin to kiss. At this point, one of the stuntmen comes in, sees the actor and test subject kissing, and begins to trash the room, threatening the test subject with physical harm, and the actress tells the stuntman “I was only trying to make you jealous! I would never date a nerd like him.” Dr. McNutty wants to gauge their reaction to this humiliation to see how they handle it: do they fight or do they simply remain quiet? Dr. McNutty will pay you $1000 for each person who completes the study. You have heard from other people at the University that in the past this same study has resulted in people breaking down, crying, and one violent outburst by a test subject. They are seeking 2 new employees; both of whom work for the competition. He wants you to steal them away by any means necessary. He also has a top employee, Mabel, who is about to quit over the scandal and he needs you to convince Mable to stay. However, the only way to do this is to prove to Mabel that you will implement programs and best practices that will prevent future scandals like this from happening.
