Instructions A case brief is a short summary and analysis of the key points of a judicial opinion. A case brief is meant to be brief outlining the important take-away points of the case, such as the main legal issue(s) in the case and the legal ruling in the case. Many judicial opinions are not written in user-friendly terms; therefore, and it takes practice to read a case and identify the key components of the ruling. Writing a case brief is a useful practice for legal research and analysis boiling down a 50-page case to less than a page to enable you or a team member to review legal authority more efficiently. When starting out in legal research and writing, creating a case brief is a helpful exercise for learning how to read a judicial opinion and efficiently extract relevant information to address your legal research question. Case briefs generally follow a specific format that helps to guide your reading of a case. The most common format for a case brief breaks the judicial opinion into the following segments: Facts, Issue, Rule, Holding/Decision, and Analysis/Reasoning. This weeks readings include explanations about how to write a case brief, utilizing this type of format. Remember, the purpose of a case brief is to condense the main points of the case — so much of the work in writing a case brief is careful reading and analysis of the judicial opinion. Please review the following case, and then write a case brief: Nelson v. Lewis, 344 N.E.2d 268 (Ill.App. 1976). This case is an Illinois Appeals Court case involving a dog bite. Length:1 page, single-spaced References: One judicial opinion; although students should draw upon at least two additional reference sources to learn how to appropriately format and write a case brief. Your case brief should demonstrate careful analysis of the key components of the judicial opinion (facts, legal issue, reasoning, and conclusion) presented in the judicial opinion and effective writing to summarize those components.
