Why do you suppose Ms. Prescott did not assert a wrongful death claim?Answer:Civil rights are supposed to protect people’s well-being from discrimation against things such as race or sex. This situation is a civil rights issue because discrimination on the basis of sex and gender was present. RCHSD was made aware of Kyler’s gender dysphoria, gender identity, and his need to be referred to exclusively with male gender pronouns. Despite assuring Ms. Prescott that they would respect Kyler’s wishes and treat him like a boy, hospital staff chose to ignore his wishes by using feminine pronouns and going as far as to make comments calling him a pretty girl.            Wrongful death claims are usually made when the death of someone you love is caused by direct negligence, misconduct, or error by another individual that has a legal obligation. For example, if a doctor fails to diagnose cancer and a patient dies because of that, it is considered wrongful death because that doctor had a duty and was negligent. In my opinion, the behavior of the employees contributed to Kyler’s death but was not the direct cause of it. Kyler was depressed and taking part in self-harm before he was ever taken to the hospital. Also, it happened over a month after Kyler was discharged.What were the responsibilities of the CAPS unit personnel in implementing the psychiatric “hold,” and why were they not carried out?Answer:The responsibilities of the CAPS unit personnel were to watch Kyler, protect him from harming himself any further, and to provide assistance with his negative feelings and urges to harm himself.Those responsibilities were not carried out. Staff of the hospital misgendered Kyler, making his dysphoria and feelings worse. They also have a responsibility to monitor the patient and make sure that they are in a much better state of mind before discharging them. The staff still had concerns about Kyler’s depression and suicidal staff, but discharged him anyway because of the conduct of the staff. These responsibilities were not carried out because the staff was unprofessional and not as caring and devoted as they should have been.What is the difference between “sex” and “gender”?Answer:            Someone’s sex is their biological makeup. It is their DNA, chromosomes, hormones, reproductive organs, chemical makeup etc. that make them technically male or female. Gender, however, is more how and individual perceives themself. Gender is defined by the culture and focuses on the roles and responsibilities, internal awareness and emotional attributes. Gender is more of a “real” picture or idea of who people are.Can you explain the terms transgender, transsexual, gender nonconforming, and cisgender?  How do they differ, if at all, from sexual orientation?Answer: For the record, different people have different definitions all over the world, but these are the definitions that I believe to be the most straightforward:Transgender: Having a gender identity that is different from the gender assigned at birth.When someone feels that their birth gender does not reflect their internal self, they are referred to as transgender.Transsexual: Usually used to express that someone’s gender experience involves hormone treatments or surgery to help better align their physical self with who they feel to be inside.Gender Nonconforming: Usually refers to those that look, dress, or even behave differently from what society expects. These individuals do not conform to the gender roles and norms that people expect.Cisgender: Refers to those whose gender identity matches the one given at birth, meaning males feel like males and females feels like females.Sexual orientation describes the gender(s) that one is attracted to. It has nothing to do with the gender that one identifies themselves as. Examples of sexual orientation are heterosexual, bisexual, homosexual, etc.How can HR policies and practices be used to deal with these kinds of situations.AnswerMost places already have policies and laws in place for discrimination. The issue is enforcing those policies and laws.
