[ORDER SOLUTION] Evidence

You are an assistant to the Special Agent in Charge (SAC) of the Organized Crime Task Force. The SAC has asked you to go over certain witness-related situations that will be testified to in an upcoming trial. The SAC has concerns about some of the witness testimony and is trying to avoid embarrassment by turning in records that may not be usable by the Assistant United States Attorney (AUSA) who is prosecuting the case.

Tommy “Two Toes” D’Natalia has a certified public accountant (CPA). He has been using his accountant to wash ill-gotten gains from his racketeering. The SAC has a subpoena for the CPA. D’Natalia is claiming privileged communication with his CPA, and it prohibits the accountant from testifying.
Luigi “the Pipe” Cardone heard through the grapevine that Big Sal Salvatore has been telling everyone how he was told by Frankie “the Lip” Bonnano that Freddie “Fingers” Malone was murdered by his wife Slippery Sally Genovese-Malone. Cardone wants a deal to testify against Slippery Sally.
Lawrence ‘Lucky’ Livorno drove the getaway car for a jewelry store heist. Bertram “Bugsy” Bertoli and Little Carmine D’Angelo went in and robbed the store. During the robbery, Bertoli shot and killed the store owner. D’Angelo and Livorno both want to testify to avoid the death penalty.
For your assignment, complete the following in 3–4 pages:

Identify which testimony is hearsay and likely to be inadmissible.
Identify which testimony is privileged communication and which is not.
Identify how the Best Evidence Rule functions in relationship to the witness testimony being proffered.

[ORDER SOLUTION] Plato and Philosophy

Discussion: Plato and Philosophy

Recent history has shown that the United States certainly has the power (i.e., the “might”) to go into any number of countries and stop human rights abuses, which are occurring in those countries. But having that ability begs the question of how far should the United States go in that role. Are we the world policeman? Are we the world’s peacekeeper? While the United States has unparalleled military power, should we engage without limits?

Based on your readings so far, and thinking about what Plato says in his dialogue with Thrasymachus, discuss the issue of when the ability to do something (the “is”) becomes the right thing to do (or the “ought”). It often helps to think in comparative terms. Think about an example that seems to be similar and use it to explain your points.

Discussion: Aristotle

Imagine you are walking down a dark street one night and suddenly someone jumps out in front of you. He is brandishing a pistol and he says in a menacing voice, “Your money or your life.” From the look on his face, you know he is serious and the pistol in his hand is real.

If you decide to give him your money—your purse or your wallet—what kind of action would this be here? Is this, as Aristotle phrases it, a voluntary or a non-voluntary action? What evidence is there to support your position? Would it matter if he did not have a pistol? Why would this be different?

Discussion: Changing History

Having the advantage of being able to know the past and see its future, offer your thoughts on one of the following questions:

If you had been the leader of the first group of English settlers at Jamestown, what would you have done differently?
If you had been Cortés, what would you have done after arriving at Tenochtitlan?
Be sure to support your initial post and responses with in-text citations from the Background materials.

Once you’ve completed your post, cross-check it against the Discussion Rubric to ensure it meets or exceeds the high-end rubric requirements.

[ORDER SOLUTION] Kant, Mill and Ethics

Module 3 – SLP
KANT, MILL, AND ETHICS
Find a moral problem in your place of employment. Tell me about it. What really bothers you and why? It need not be actually happening. The moral problem could be a potential problem, no matter how likely. Be creative. If you can’t think of a real problem you will likely face, make one up.

Tell me what your position on the problem is, and what the relevant utilitarian and deontological considerations are. Who is being, or will be, hurt? Who is being, or will be, benefited? Why, overall, do you think your position on the issue is for the greatest good over the long haul? Whose rights are involved? Who has special duties?

Here are some possible topics:

Privacy in employment tests
Privacy in genetic tests
Privacy in e-mail—should your boss be allowed to read your e-mail?
Safety issues
Fair employment practices (e.g., pay, hiring/firing, benefits)
Racism
Sexism
Discrimination on any unfair basis

[ORDER SOLUTION] Leading-Edge Metrics of Organizational Personnel Readiness

What are the leading-edge measures/metrics of organizational personnel readiness? The focus of the research is for a non-DOD audience.

My expectations:
– full prose with appropriate use of headings/subheadings, bullets, tables, as needed to convey information;
– provide an overview of what’s trending (and where) as well as what are the major themes or “buckets” within which personnel readiness can/should be categorized;
– describe the intent of key readiness measures – form-follows-function, so it is often more important to understand the why behind the what; and
– include footnotes and/or hyperlinks to the underlying reference materials cited/used.

Do not include:
– non-sourced content which others cannot source or review; and
– solely traditional or staid metrics.

Question 1
Congress passed the Internal Security Act over President Truman’s veto. Also known as the McCarran Act or the Subversive Activities Control Act, it strengthened laws against espionage, allowed investigation and deportation of immigrants who were suspected of subversive activities or of promoting communism or fascism, and allowed the limitation of free speech for national security reasons. President Truman vigorously opposed the law that he believed “would make a mockery of our Bill of Rights [and] would actually weaken our internal security measures.” In 1993, sections of the act were ruled unconstitutional by the Supreme Court.
In an essay, identify what sections were ruled unconstitutional and why.
