Landlord–Tenant Law

Suppose a tenant came to our law firm and said that she had just been locked out of her apartment by the landlord. She hadn’t paid rent in three months, so she thought it was possible that the landlord had a right to lock her out. However, she also considered it possible that the landlord couldn’t lock her out unless he first went through some kind of legal process – and she hadn’t received anything in writing that indicated that he had done that. So the situation presents a legal question: “Was the landlord legally entitled to repossess his property by locking out a tenant who failed to pay her rent for three months?” You do the legal research and find a valid statute that seems relevant and reads in part as follows:

Types Of Contracts

Select two of the scenarios provided below. Analyze the facts in the scenarios and develop appropriate arguments and recommendations using case law and scholarly sources. Do not copy the case studies into the paper. Cite your sources in APA format on a separate page. Scenario 1:  Consideration and Capacity Lucinda is on her way home to Grand Rapids, Michigan, from boarding school in Lansing Michigan   to celebrate her 17th birthday with family.  Lucinda’s car has a flat tire in an ice storm and skids into a ditch.  Lucinda is able to walk to the nearest house where an elderly couple offers her food and shelter until her car can be fixed.  Two days later, the snowplows cleared the road, the car is pulled out of ditch, the tire is repaired, and Lucinda is on her way home.  Lucinda’s mother, Louise, is so appreciative of the couple’s care for her daughter that she sends them an email promising to pay $500 to help cover the expenses.  Living on a fixed income, the elderly couple accepts the offer by return email.  Lucinda and her mother get into an argument and Louise refuses to pay couple.  Can the couple hold Louise liable in contract for the services provided to Lucinda? Provide arguments for the parties, determine the outcome and support your answer with scholarly material. Scenario 2: Types of Contracts Dr. Brown was an adjunct instructor North State University (NSU) in Michigan.  Each semester, near the beginning of each term, the parties executed a written contract that always included the following provision: “The parties acknowledge that this agreement may be cancelled by NSU or the instructor at any time before the first class session.”  In the spring semester of Brown’s  sixth year, he filed a complaint with NSU claiming that one of his students, Sylvia Davis, had engaged in inappropriate and disruptive classroom conduct.  Brown gave her an “incomplete” grade and asked NSU to require her to apologize as a condition of receiving a final grade.  NSU claimed, and Brown denied, that he was told to assign Davis a grade if he wanted to teach in the fall.  Toward the end of the semester, Brown was told which classes he would teach in the fall, but the parties did not sign a written contract.  The Wednesday before classes began, NSU terminated him.  Brown filed a suit against NSU and others, alleging breach of contract.    Did the parties have a contract?  If so, what type of contract did they have. Did NSU breach it?  Explain.

Social Disorganization Theory

I need a PowerPoint created and an paper to follow. Question #3: Construct your own theory building on the research of three disorganization theorists. what is and how does social disorganization develop? select an example and apply the theory. research paper Summary: This project requires you to study three theorists based on a research question that you select, identify the strengths and weaknesses of the base theories and develop your own theory. YOUR WILL NEED TO DO ADDITIONAL RESEARCH ON YOUR THEORIES BEYOND THE TEXT AND ALSO ANSWER HOW THESE THEORIES APPLY TO ADULT OFFENDERS SPECIFICALLY. IN ADDITION, YOU SHOULD WATCH ALL OF THE MOODLE VIDEOS ABOUT YOUR THEORY AND BE PREPARED. This is a research paper assignment with a twist. It requires you to research the information, develop your own original theory and then apply what you’ve learned using real life examples. DON’T FORGET TO INCLUDE YOUR DIAGRAM IN YOUR PRESENTATION AND YOUR PAPER!!! Please submit a minimum of 5 paged double-spaced typed paper—12 Tahoma font. Please cite all sources[1]. Grammar and sentence structure are important! This assignment includes an individual paper and an individual PowerPoint or Prezi presentation. This paper requires you to use three different theories as the basis for a new original theory created by you. You are must prepare an oral presentation. There is a minimum of 7 slides not including the title page that lists the question, question number and your name and a works cited slide that lists your resources. Your presentation and your paper should include an illustration created by you that graphically depicts your theory. The presentation requires you to discuss the theories and concepts that you are using as the basis of your theory and then analyze the validity of this construct. Why is your theory better? For example, my theory is…based on the following three theorists. I selected blank components from each of these theories and used them to form the blank theory. In evaluating the blank offender or phenomenon, my theory when applied explains the behavior/phenomenon in the following way using the following features. I conclude the following in the context of this offender … The (blank) theory states that… I (Author) first developed this theory… in (year). I (Author), while studying in, teaching in or working for (place) tested the theory in research studies or the theory remains untested. The genesis of the theory is… Its major assumptions are… Its strengths are… Its weaknesses are … You will be graded on your organization; knowledge of the base theories or concepts; originality, presentation of the theoretical foundation of your argument; initial statement of your position; response to the issue you are examining; eye contact; elocution; handouts distributed to the class; and you need a diagram to visually explain your theory; your PowerPoint or Prezi will be graded on mechanics, organization should be visually pleasing with graphics and should include a handout for the class. COMMON MISTAKES 1) Did not develop your own theory. The papers thoroughly discuss the foundation theories and then devote a paragraph or two to the main reason for the paper YOUR OWN THEORY! This is the most important part of the paper. 2) High similarity score. Since I deduct the similarity from your final score this can be devastating. 3) Did not review the rubric to see what was supposed to be covered by the paper. 4) Did not use three theories. Come on Shaw and McKay are not two theories-it’s the same theory by two theorists. 5) Did not mention the person who created the theory that you used. 6) Did not include the strengths and weaknesses of your foundation theories or your theory. This is really important because the strengths of the other theories should be part of your new theory and the weaknesses should be “solved” by your new theory. 7) If I told you that you had to represent and your presentation mirrored your paper it’s wrong as well. YOU SHOULD FIX THESE ISSUES IN your paper. [1] You need a minimum of five sources (excluding the test); at least two should be scholarly articles or books; Internet sites must be saved in pdf form and attached.

Property Rights

Please choose one of the following three writing topics: 1.The main question to which you should be responding is highlighted in bold print below. In developing your essay, do not simply answer the questions in order, but try to connect your answers into a coherent essay. The questions are simply intended to stimulate thought on your part, to give you some idea of the kinds of questions you should be considering in your answer. Do you think animal liberation is a crime? If so, what makes it a crime? If not, how do you define a crime, and how does the liberation of animals fall short of that definition?  Do you think the original owners of the animals have rights – for example, property rights – that are violated by their “theft”? Should the liberators have to compensate their “victim”? If the dolphin in Midgley’s essay was truly treated inhumanely, do the owners deserve compensation? Who, then, would be the true victim in that scenario? What constitutes inhumane treatment in the first place? (Notice the equivocation here: The word “inhumane” comes from the word “human.” Are animals, if they are not human beings or persons, entitled to “humane” treatment? What is your definition of “human” or “person,” and to what extent do animals fall under it?) If you do not consider animal liberation theft, explain why not. What moral principle(s) would you invoke here to defend your answer? Would you make an exception in the case of animal testing (i.e. experiments with animals) for the sake of developing life-saving medicines for human beings? How about for the sake of developing perfume, shampoos, lipstick, and other beauty products? Do you think it should play any role in determining the liberator’s guilt whether (or how well) he knew the animal? In other words, if someone off the street decides, as a matter of principle, to free a dolphin from Sea World, should he be treated in the same way as someone who knew the animal “personally”? If not, what is it about knowing the animal and its condition that changes the legal circumstances? Why should that play a role at all? Should that completely exonerate the person or only be a mitigating circumstance?
