A case brief is meant to be “brief” – outlining the important “take-away” points of the case, such as the main legal issue(s) in the case and the legal ruling in the case. Many judicial opinions are not written in user-friendly terms; therefore, and it takes practice to read a case and identify the key components of the ruling. Writing a case brief is a useful practice for legal research and analysis – boiling down a 50-page case to less than a page to enable you or a team member to review legal authority more efficiently. When starting out in legal research and writing, creating a case brief is a helpful exercise for learning how to read a judicial opinion and efficiently extract relevant information to address your legal research question. Case briefs generally follow a specific format that helps to guide your reading of a case. The most common format for a case brief breaks the judicial opinion into the following segments: Facts, Issue, Rule, Holding/Decision, and Analysis/Reasoning. This week’s readings include explanations about how to write a case brief, utilizing this type of format. Remember, the purpose of a case brief is to condense the main points of the case — so much of the work in writing a case brief is careful reading and analysis of the judicial opinion. Please review the following case, and then write a case brief: Nelson v. Lewis, 344 N.E.2d 268 (Ill.App. 1976). This case is an Illinois Appeals Court case involving a dog bite.
